It symbolizes the secularization of our history and the disincarnation of the Christian God. (Albert Camus, The Rebel 120; quoted in Dunn 140) Susan Dunn makes a well-documented case that the death of Louis XVI was unconsciously understood, especially by the Jacobins, as a human sacrifice that was necessary for the founding of the republic. "Louis must die because the patrie must live," said Robespierre at the king's trial, and the representative Carra considered Louis "the source of corruption and servitude... the fatal talisman ofall our ills" whose death would cause the people to be "regenerated in morality and virtue" (Dunn 15-37). The king was a monster and the source ofall the ills, and his death 68Robert G. Hamerton-Kelly had the power to alleviate those ills and regenerate the nation. This image of the king as sacrificial victim persisted throughout the first half of the nineteenth century in French literature and politics, sometimes assimilating itself to the image of Jesus Christ who died for the sins of the world. Legitimist writers like Joseph de Maistre saw his death precisely in this light as a great Christian sacrifice that would do France and the world good (Dunn 28-37). The king as a sacred monster whose life causes all ill and whose death brings healing is the classic figure of the scapegoat or sacrificial victim identified by René Girard. Susan Dunn recognizes this but because she does not know Girard's mimetic theory she is not able to explain the significance of the scapegoat king. Her work is, indeed, as Conor Cruise O'Brien says in the foreword, a work ofdemonstration rather than argument, of evidence rather than interpretation. I offer a mimetic interpretation ofthe Jacobin claim that the death ofthe king was the human sacrifice that founded the republic, and an argument that a universally operative generative mechanism forged the historical events of the revolution.1 There is no essential difference between the sovereignty ofthe king and the sovereignty of the people. In both cases sovereignty arises from a metaphorical contract that threatens death to anyone who violates it. The royal metaphors are organic while the revolutionary metaphors are legal and rational, but they all express the sacrificial structure ofpolitical power. Revolutionary democracy imports the fiction ofrationality to obscure its sacrificial structure. The desire ofthe general will for contractual equality is a transformation of mimetic desire in search of a victim around which the bad violence ofmimetic rivalry can coalesce into the good violence of sacred order. Sovereignty, therefore, is structurally single and simple; it is violence transformed through the sacred into the powers oforder. Max Weber understood this in general ifnot in its particulars when he defined sovereignty as the monopoly of the means of violence within a single territory.2 1 Mimetic theory was discovered by René Girard. In this article, I re-examine the relationship between the thoughts of contemporaneous and associated late twentieth-century French philosophers Michel Foucault and Louis Althusser, through the prism of the notion of the problem. I discuss the philology of the use of the noun “problematic” in French philosophy in relation to Foucault and Althusser’s use of it, concluding that while Althusser makes this a term of art in his thought, Foucault does not make any particular use of this concept. I nonetheless (...) consider the possibility of the existence of a similar notion under a different name, episteme, in Foucault’s thought, but conclude that this is a distinct notion from Althusser’s “problematic.” I then consider Foucault’s later, idiosyncratic notion of problematization and its possible relation to Althusser’s conceptual framework. I conclude that, despite divergent vocabularies, Althusser and Foucault do have a common problematic and approach to problematization, though Foucault also problematizes aspects of Althusser’s problematic, effectively taking problematization a step further. Abstract In an engaging and ingenious paper, Irvine (1993) purports to show how the resolution of Braess? paradox can be applied to Newcomb's problem. To accomplish this end, Irvine forges three links. First, he couples Braess? paradox to the Cohen?Kelly queuing paradox. Second, he couples the Cohen?Kelly queuing paradox to the Prisoner's Dilemma (PD). Third, in accord with received literature, he couples the PD to Newcomb's problem itself. Claiming that the linked models are ?structurally identical?, he argues that (...) Braess solves Newcomb's problem. This paper shows that Irvine's linkage depends on structural similarities?rather than identities?between and among the models. The elucidation of functional disanalogies illuminates structural dissimilarities which sever that linkage. I claim that the Cohen?Kelly queuing paradox cloaks a fine structure that decouples it from both Braess? paradox and the PD (Marinoff, 1996a). I further assert that the putative reduction of the PD to a Newcomb problem (e.g. Brams, 1975; Lewis, 1979) is seriously flawed. It follows that Braess? paradox does not solve Newcomb's problem via the foregoing and herein sundered chain. I conclude by substantiating a stronger claim, namely that Braess'paradox cannot solve Newcomb's problem at all. (shrink)

An astrologer (McRitchie) replied to our article criticizing the claims of astrologers who hold that psychic or supernatural factors play a role in astrological readings (JCS, 2003). However, McRitchie mistakes our 2003 JCS article 'Is Astrology Relevant to Consciousness and Psi' for an attack on astrology when it merely asks if the performance of astrologers has implications for consciousness and psi. For example, he attempts to validate astrology by citing studies we ignored and by highlighting the supposed flaws that made (...) our tests useless. A proper scientific validation of astrology or any other practical field would critically review the existing empirical studies and then demonstrate replication of effect sizes commensurate with the claims. But McRitchie does not do this, which is most easily explained by the seeming impossibility of doing so. Our conclusion that the performance of astrologers has no useful implications for consciousness and psi is unchanged by recent or previously missed studies, whose outcomes we describe. (shrink)

Paul W. Taylor has defended a life-centered ethics that considers the inherent worth of all living things to be the same. l examine reasons for ascribing inherent worth to all living beings, but argue that there can be various levels of inherent worth. Differences in capacities among types of life are used to justify such levels. I argue that once levels of inherent worth are distinguished, it becomes reasonable torestrict rights to human beings.

The article examines the question of whether business ethics courses ought to have an impact. Despite the still common attitude among students and some business professionals that ethical considerations are less pressing in business, I argue that moral obligations are just as important there as elsewhere. The emphasis on profits in business is related to other realms (e.g., hobbies and seeking and education) in which, though private goals are dominant, moral limits remain in force. The major argument of this article is that failing to measure what is taking place in treatment and control conditions can lead to scientifically invalid conclusions. It is argued that researchers are ethically responsible for being aware that variables related to the therapist, client, and the therapeutic relationship might play a confounding role when treatment and control conditions are compared. As a consequence, they should either measure these variables or be tentative in their interpretation of their findings.

Chow (1996) offers a reconceptualization of statistical significance that is reasoned and comprehensive. Despite a somewhat rough presentation, his arguments are compelling and deserve to be taken seriously by the scientific community. It is argued that his characterization of literal replication, types of research, effect size, and experimental control are in need of revision.

We develop a vision of consumer responsibility in purchasing decisions in light of the Coalition of Immokalee Workers’ boycotts. These boycotts succeeded in convincing large fast food companies and national supermarket chains to pay tomato growers a penny more per pound, to improve working conditions and wages for pickers. The C.I.W. efforts to generate consumer support eschewed claims associated with rule-based obligations in favor of appeals more typically associated with virtue and caring ethics. The strategies encouraged consumers to understand the (...) plight of tomato pickers and to extend concern in an effort to improve the world. These strategies are associated more with encouragement to contribute to the social good rather than claims that in refusing to help, consumers would fail to fulfill an obligation. Insights from virtue ethics and caring ethics are offered as a model for a broader account of consumer social responsibility. (shrink)

This paper presents an integrative, descriptive model of ethical decision making, with special attention given to issues of measurement. After building the model, hypotheses are developed from a portion of it. These hypotheses are tested in an exploratory analysis to determine if further research and testing of this model and the measurement instruments it employs are warranted.

Schools may be one important context where adolescents learn and shape the behaviors necessary for promoting global inclusivity in adulthood. Given the importance of bystanders in halting bullying and peer aggression, the focus of this study is on both moral judgments regarding one type of bullying, social exclusion, and factors that are associated with bystander intervention. The study includes 896 adolescents, who were 6th, and 9th graders, approximately evenly divided by gender. Participants were primarily European–American. Results revealed that girls and (...) participants who perceived better relationships between students and teachers were more likely to judge exclusion to be wrong. Further, ethnic minority participants, those who were more anxious about being rejected by their teachers and reported more teacher discrimination were less likely to judge exclusion as wrong. Participants who reported more positive student–teacher relationships, perceptions of a more positive school social environment and more prior experiences of teacher discrimination were more likely to report that they would seek help for the victim. On the other hand, participants who reported being more angry about teacher rejection, experiencing either peer or teacher discrimination, and perceiving they are excluded from opportunities at school were less likely to intervene to come to the aid of a peer who is being excluded. The results document the complex interplay of school and teacher factors in shaping adolescents’ bystander responses to social exclusion. Our findings suggest that positive school climate can promote intentions to intervene. However, findings indicate that adolescents who are marginalized in their school environments, and who report experiences of rejection, exclusion or discrimination are not willing or likely to intervene to prevent others from experiencing exclusion.
